Issue Brief: Death Penalty

Do people who commit horrible crimes deserve to die? Should the U.S. keep the death penalty?

The Eighth Amendment to the U.S. Constitution says:

“Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted.”

The Eighth Amendment protects the rights of Americans after they have been convicted of a crime.
